On that point he and Larson agreed, but Larson said it was unfair to simply expect a bailout from other taxpayers. That's why he prefers levees high enough to thwart any flood or low enough to trigger an insurance requirement.
The greatest flooding since most of Fort Bend's levees have been built occurred from Christmas 1991 to New Year's Day 1992, said Hebert, who once ran a company that operates and maintains many of the county's levees.
That event was an estimated 35-year flood, he said, and it barely lapped at the foot of the levees.
Meanwhile, the county is waiting for the results of the LIDAR study. If the flood plain has risen, millions of dollars might need to be spent to put new clay on top of the levees.
Economically, it's hard to argue with the levees, Goff said. Sienna Plantation's levee cost perhaps $12 million, and the assessed value of the property behind it has jumped to $1 billion.
"When you invest in levees like we do, you never stop asking questions as to are they tall enough, wide enough, well maintained enough, etc." Hebert said. "If you continue to do that, they'll do their job." . . .(read the entire article by clicking the title link above).

Audit Report Sheds Light On Workings Of ECO Billing Scam

A scam that cost 11 municipal utility districts more than $185,000 was made possible because ECO Resources’ accounting system allowed the same manager to create, close and finally approval service orders.
That conclusion was reached in findings by Lancaster forensic accounting firm Dave Gillis and Associates, hired to assist in an investigation ECO conducted into over-billings it discovered in September.
Sugar Land-based ECO presented some of the Gillis firm’s findings in meetings Friday, attended by presidents of many of the company’s 125-plus local MUD clients.
The findings show that the fraud involved “one person acting alone,” said John Boardman, manager of ECO operations.
“This individual took advantage of a gap in the internal controls. Specifically, the contract manager was able to initiate, close and provide final review of service orders to a MUD, where she sought reimbursement for an item that was not linked to any labor, but was allegedly obtained for a MUD as an accommodation,” the Gillis firm said in a letter summarizing its findings. “This gap, which has been closed, existed to expedite customer service, but unfortunately was exploited by the CM.”
The firm also found that “a number of vendors, addresses, Internet sites, invoices, telephone numbers and other relevant data (utilized by the employee in supporting the service orders and related employee reimbursements) were false.”
“By having control over the initiation, closing and final review of certain service orders which contained no labor component and were for certain unusual products,” Gillis said in the letter, “the
employee was able to falsify supporting information resulting in incorrect billings to certain MUDs.”
The Gillis letter didn’t name the contract manager responsible for the scam, however, officials with ECO and local MUDs confirmed in October that Janet E. Trentham of Missouri City was terminated because ECO believed she perpetrated the fraud.
Trentham was sued in mid-October by First Colony MUD #9, which accuses her of taking more than $25,000 from the district through fraud.
A First Colony MUD #9 board member said Friday the district was told by an ECO official that “on advice of counsel,” their district president was not invited to attend the Friday sessions.
ECO also has agreed to turn the Gillis firm’s forensic audit over to Fort Bend County District Attorney John Healey, who has said that if he believes the findings warrant a criminal investigation, he’ll turn the matter over to the Texas Rangers.
Healey said Friday his office hasn’t received a copy of the audit, adding “I would be surprised if they don’t get me the audit within a reasonable amount of time.”
ECO’s Boardman said only the portion of the audit relating to the over-billing of the MUDs has been completed, information from which ECO was anxious to present to MUD officials. He said the complete audit probably won’t arrive at the district attorney’s office until January.
Founded in 1972 by Fort Bend County Judge Robert Hebert, ECO was sold in the 1990s to Southwest Water Co., a publicly traded Los Angeles-based company with whom Hebert still serves in a consulting role.
When ECO managers informed Southwest Water of the apparent billing scam, the corporate parent immediately hired Dallas law firm Jenkens & Gilchrist and told them to hire forensic accountants to “among other things, fully investigate the billings,” the Gillis letter states. The law firm told Gillis that it was Southwest Water’s priority to “both fully reimburse any MUDs that may have been over-billed and to enhance the controls related to the billing process.”
For its investigation, the Gillis firm said it had unrestricted access to company personnel, supporting documentation and ECO employee computer hard drives. The scope of the audit included determining any over-billings; reviewing all contract manager reimbursements going back two years, and in Trentham’s case, going back to the start of her employment with ECO; reviewing ECO’s internal billing controls; and recommending how to “enhance internal controls to reduce the likelihood of future billing irregularities.”
Gillis’ recommendations to improve financial controls were:
→ Require a second contract manager to approve a bill to a MUD in the event that a contract manager has initiated the service order and has closed such order;
→ Require the approval of an individual within operations for service orders that have been initiated and closed by the same contract manager.
→ For service orders that do not include labor and equipment, an accounting supervisor should approve any changes made to the invoice which have been requested by the assigned contract manager.
“We identified the false transactions and ECO has reimbursed the MUDs for the over-billings plus interest,” the Gillis firm concluded in its letter. “ECO has informed us that they have initiated controls to address the three recommendations above.”

2003 Plans To Expand Airport In Arcola Secretly Moving Forward
I went to Austin to meet with TxDOT Aviation officials earlier this week, and was shocked to discover that they are still working on expanding Houston SW Airport EXACTLY as prescribed in the 2003 Feasibility Study.
This is the same Feasibility Study which was approved by Commissioners Court in July 2003 due to Judge Hebert’s incorrect claim that the County would be required to repay the $500,000 if the Court did not accept it. This is the same plan that was overwhelmingly rejected by the City of Arcola, Area Residents, and declined acquisition by Fort Bend County itself over 2 years ago.
So now they are going ahead with the plan to expand the airport anyway – they are just not telling anybody. They are claiming that the 22 properties presently being surveyed for possible purchase by the airport east of the runway are being bought for “safety purposes.”
However, Arcola City Councilman Greg Abarr called me last week and said that Judge Hebert admitted to him that he had seen plans illustrating that the airport owner is indeed planning to extend the runway 950 feet eastward. Abarr was reportedly upset over this revelation, and told the Judge that the deal (South Post Oak) was off, as he felt he had been lied to by Mr. Griffith. However, by Monday of this week, Abarr had flopped on this decision, and the deal was back on.
Judge Hebert is continuing to fight for this expansion, even though it is presently an unsafe airport (it’s currently out of compliance with FAA safety regulations) and such expansion would make it even more unsafe (plans show a possible 1,400-foot extension to the runway). One example of Hebert’s quest is the Dec. 20, 2005 letter from the County to the FAA where they asked leading questions in the hope that the FAA would respond in kind. This would allow the County to place blame for confiscating the 10+ acres in Newpoint Estates on FAA regulations, and not on their blatant attempt to use government power and taxpayer funds to unfairly take land from some citizens for the sole benefit of private business interests.
Unfortunately for Judge Hebert, the FAA’s reply did not respond to their leading questions, but simply approved the layout intruding into Newpoint. I had heard that the Judge was very upset about this.
An example of these leading questions in addition to false claims in this letter are;
“Given the traffic count associated with increased development south of McKeever in Sienna Plantation and other areas, a new alignment is absolutely necessary.”
FALSE. Steep Bank Trace has nothing to do with South Post Oak for one thing. Studies by the HGAC show the traffic count to be 200 cars/day presently with a projection of 600 cars/day on McKeever – no critical traffic relief needed here Judge. In addition, all plans to date show the closure of McKeever from the point extending eastward from the connection with South Post Oak, thereby causing more congestion, not less.
“McKeever Road cannot provide the needed relief because westbound traffic on Highway 6 cannot exit onto McKeever due to the Highway 6 overpass at FM521 recently built by TxDOT.”
FALSE. I live off of McKeever, so I know that when I’m westbound on Highway 6 heading toward FM521, there are very large signs showing the exit to McKeever Road. This is how I get to my home – claiming that westbound traffic cannot currently exit onto McKeever is a blatantly false statement Judge. (The Judge is apparently referring to the future here, where that claim would be true when the City of Arcola gives away the R.O.W. of McKeever to Griffith in exchange for the annexation of the 90 or so acres excluded in the recent Interlocal Agreement between the County, Griffith, and Arcola).
“You have informed us the FAA flight safety standards would not allow expansion of the existing McKeever, or a replacement thoroughfare, at locations within a certain radius of the end of the runway, which happens to be near Newpoint Estates.”
FALSE. McKeever Road was an existing road when the airport was developed, and the airport owner built the runway too close to McKeever, thereby endangering the residents using that road. The FAA cannot prevent the County from upgrading McKeever or building a “replacement thoroughfare.” This airport has received about $1.3 million to date for the specific purpose of bringing it into compliance. Taxpayers should not be asked to foot the bill for bringing this airport into compliance – the airport owner needs to remove about 565 feet from the west end of the runway to do so. This would alleviate the need for the County to go into Newpoint Estates to confiscate the property there, and would allow the upgrading of McKeever on its present location.
“You indicated that although the FAA could not prevent the County from building the road, if the County were to violate those flight safety requirements and ignore FAA objections, the Airport might have a cause of action for damages resulting from the County’s non-compliance with those FAA flight safety requirements.”
FALSE AND MISLEADING. This statement is in direct contradiction of the previous statement. The County is not required to comply with FAA flight safety requirements Judge, the Airport is required to comply with FAA flight safety requirements. This is a blatant attempt by the Judge to have the FAA respond in a manner where the County could then point to FAA regulations forcing the confiscation, when in fact, they don’t.
“Further, if there were to be a future accident involving air operations and traffic along the road, the County might be subject to civil and/or criminal penalties for unlawfully obstructing/interfering with airspace regulated by the FAA.”
FALSE AND MISLEADING. The runway is unlawfully violating McKeever Road’s safety by being built too close to the road in the first place. The County will be subject to civil/criminal litigation by residents of the County if there is an air operations/traffic accident, as it is the responsibility of the County to ensure the safety of the citizens driving on its roads. The action that needs to be taken is for the County to force the Airport to take McKeever Road out of danger, Judge.
In addition Judge Hebert, the possibility of the Airport extending its runway 950 feet eastward should be of concern to County officials. If, after repeated warnings of the clear and present danger of the existing layout of this airport are ignored, and the runway is extended due in part by the County’s help, the County will be liable for damages resulting from such, when the inevitable catastrophic accident happens.
This South Post Oak Road project is being done solely for the benefit of this airport, and takes much-needed funds away from other mobility projects in the County that are ACTUALLY needed. All one needs to do to find proof of this, is to read from the letter from Mr. Griffith to then-County Judge Adolphus 6 years ago in April 2000: “An integral part of the future development of Houston SW is the expansion of the airport north across McKeever Rd…In order for this to happen, McKeever Road needs to be diverted up to Highway 6 where it will tie into South Post Oak.” There you go Judge, straight from the horse’s mouth – any further claims to the contrary from you or other officials claiming otherwise is nothing more than propaganda.
The South Post Oak Road project MUST die a well-deserved death, or the County will be complicit in disregarding the safety and welfare of Fort Bend County Residents.

Once again Tom Hilton has caught our elected officials with their creative attempts to disregard the truth and misinform the taxpaying/voting public.
Rerouting McKeever Rd., rather than fixing it on its current location near hwy 521, will only create further traffic nightmares on hwy 6. 10,000+ residents/homeowners do not need or desire another exit from the Sienna Plantation area onto hwy 6. This does not address our mobility needs and allows for the unwanted airport expansion that will do harm to our home and property values. This doesn’t even begin to address the many other communities in this area that will be negatively impacted like Colony Lakes, Silver Ridge, Waterbrook West, Waterbrook, Oyster Creek, Oakwick Forest, West Pointe, etc…
I’m not sure what the local politicals think they are up to, but ignoring the voters, taxpayers and property owners in this area will only back fire on the plans to help this private airport and its owner.
When we moved here to Sienna 2 years ago we were told that the airport was not going to grow into a large regional airport (like the Sugar Land airport) and already it has been named a Hobby reliever.
During the recent Rita scare many jets were rerouted to this airport and those of us that stayed listened to them as they landed every few minutes (not an inviting sound—makes it hard to sell your home too).
To complicate this further. Our developer here in Sienna has released information that they support the road diversion, but not the airport expansion, when they know full well that these decisions are not mutually exclusive but part of the Hebert-Griffith gift.
I would like to encourage those who live on either side of this fly-way and closer into the airport to vigorously oppose this effort by our developer, Bob Hebert, Jaime Griffith, some on the Arcola city council that will ruin our property values and quality of life. I would also like to ask our developer’s long time friend Allen Owen, mayor of Missouri City, to contact Mr. Hebert and tell him this expansion will hurt the tax base of this city (of course remember that Owen contributes to Mr. Hebert’s campaigns).

Well, I guess consider me a ‘boob’... I’ve contacted the airport myself to ask those very same questions and, I guess I was outright lied to by the general manager of operations. Since moving to Texas a few years back I am still trying to catch onto the need for lies and deceit down here. Folks, if you don’t want to answer the questions don’t but, don’t lie to the person either. Hope the person I spoke to on the phone and she knows who she is, reads this.
Does this mean the airport owner won’t financially benefit from this effort as Hebert originally stated?
It’s bad enough that we have a 30” gas pipeline running next to the homes a block and a half away, which we were never told that is was a 30” pipe and now deal with a ‘pipeline’ patrol plane almost every morning doing a fly by 300’ above, which will only get more frequent as the population groups out here by what the DOW contact indicated and Texas law mandates.
The trains shake the living mess out of ours homes, we were told the track was ‘defunct’ at best, worse was once a week. Now, from contacting the railroads themselves, UP and BNSF it is only going to get more frequent too… one train system services the coal plant south of us… anywhere from X number to over 120 cars of coal will be pulled through this area. The other one is increasing loads and train volume through this area because the hub around Houston in getting overloaded.
Now, yes, now… jets overhead! Why didn’t I buy a loft in the city next the airport or train depot and a chemical plant? Hmm… I could have saved some money. Because with all of this going on I hate the thought of selling my house… I can see it now… “here is the dining room(shaking from train), and here is the back yard(roar of pipeline patrol plane and and jets)”.
If anyone is interested in the contact numbers for these companies please contact me… don’t take my word for it contact them yourself.

Why is it so difficult for those people who get paid by us, our elected officials to be honest with us. I have lived on property at the west end of the airport for eight years and I am sick and tired of the continual double talk. If you want to develop the airport then let everyone know so that those of us who will be directly affected can make informed decisions about our property. While I am less than surprised by the shinanigans which go on in Washington, I am very disappointed that local officials, individuals who live where we do find it acceptable to “try” to keep us in the dark on government action which will have profound effects on our lives. I would say to Judge Hebert and the entire county commissioners court that your less than straightforward actions are not what I would expect from individuals who are elected to serve those who elect them and whose taxes pay for the decsions they make each day.

Fort Bend County and Arcola’s Mayor/Council are selling out the people of Arcola over the expansion of Houston SW Airport. The Mayor will not tell the people what is going on, but covers up the fact that the whole thing is to give the owner of this airport what he wants financially at the expense of the economic future of Arcola. We don’t need to extend South Post Oak Road or close a portion of McKeever Road due to the simple fact that McKeever has very little traffic. The last large parcel of land inside the City Limits, 217 acres located south of the airport, could and should be developed if this airport expansion concept would be dropped. The Mayor of Arcola should devote more time to bringing water to this city. New economic development is actually being sidetracked because the Mayor is too occupied with satisfying the wishes of Jamie Griffith, owner of Houston SW Airport.

This is just more of the “same old same old” junk that we have been dealing with around here for years. For those of you new to Missouri City, there used to be a train track that ran up from the plantation along side of Mckeever(now Sienna Parkway) and crossed Highway 6. McKeever used to be a dirt road. The airport USED to be quiet, and was only used by smaller privately owned planes. We used to have huge corn fields where there were quail(how do you think Quail Valley got its name?) THere USED to be peace and quiet, and know and love thy neighbor. NOW….with all of this development, we should all just move to Manhattan…...it is soooo sad. Th destruction of the pecan grove on Highway 6 in one day(I guess that was all done so people couldn’t complain until it was too late) The loss of thousands and now possibly tens of thousands of acres of wetlands and hardwoods. I am wondering if these guys are planning on damming up the creek the runs under Trammel Fresno??????? Seems to be the one and only place on this side of Fort Bend county where a person can actually see beaver and river otters…..Don’t believe me? Go check it out!

Do we really need a bigger airport? Another exit onto Highway 6?(How about using some foresight guys and putting a road from Sienna Proper to Sienna Point so the school kids won’t have to endure and hour long bus ride everyday by going 15 miles out of their way. )Or how about building a school that will not have temporary buildings surrounding it within two years? Wow! What a novel idea!!!! Out with the old and in with the new seems to be the mantra these days. Bigger and better, more expensive! Thats great and all but when you start to mess with people’s way of life, you need to sit back and rethink….....

This is an indictment of the County and Arcola governments’ lack of honesty and their lack of willingness to do what is best for their electorate. Their only concern is to kowtow to the interests of the developers. God knows, Arcola doesn’t even want to develop a plan to determine what’s best for it’s own City, as it may interfere with what the airport owner wants. I have to ask – what is their interest here? Could there be money exchanging hands under the table here? I don’t know, but this seems to be the only logical explanation – maybe an investigation is warranted here.
ON THE EAST SIDE: Houston SW and TxDOT Aviation are claiming the land acquisition is being done for a “safety Zone”, even though this is exactly the land needed when they were planning a 950 extension of the runway there. There is no equal “safety zone” planned on the west side – strange, if they are not indeed planning a substantial extension to the east.
ON THE NORTH SIDE: Arcola is abdicating any negotiating leverage (control of the streets, water to the property, etc) and failing to negotiate in good faith for the best interests of the City. The Mayor and Greg Abarr claim that McKeever will never be closed, but refuse to answer specifically how that will happen when showed plans showing McKeever dying into South Post Oak. They both make progandistic statements at Council meetings, yet refuse to field questions regarding those statements.
ON THE WEST SIDE: Judge Hebert is grasping at straws trying to justify diverting McKeever into South Post Oak; (A)”Critical Traffic Relief Needed (?)”,
(B) “FAA Flight Safety Requirements dictate confiscation”, (C) “Airport Owner is donating $500,000 (although it would cost about $1,000,000 to purchase Newpoint properties and more $ required due to damage of Mrs. Neuhaus’ property values), (D) “The Judge was unaware of any plans to revamp and enlarge the current airport because the demographics of the airport limit what can be done…(?)”, (E) The airport would benefit inadvertantly from the South Post Oak project…yeah, right. (Refer to April 2000 letter from Grifith to Adophus – at least Griffith was speaking the truth there!)
Give it up, Judge – you are trying too hard – and who knows, there may be consequences to your actions. We’ll see.
I have called Greg Abarr and alerted him of this article, and have invited him to respond. It will be interesting to see if he will – I doubt it though, because then he would be required to state his position in writing instead of the empty words that he likes to throw at us. The only thing that I am interested in Mr. Abarr, is action – not empty words.
I look forward to the democratic process of cleaning house this May at the Arcola Govt level. Looks like the powers-to-be are trying to put all of this to bed before the May election.
I guess we’ll see what happens after the May election, eh?

With the new information of the expansion of the Sugar Land airport it makes wonder if this is not really just a tax payer funded effort to help Jamie stay competitive. Sugar Land could drive this airport out of business so why even bother expanding it?
Let’s take it a step further. If this airport can not compete with the new and improved Sugar Land airport what else would the land be good for? The land would only be framed on 3 sides by the new “Post Oak road, Hwy 6 and 521? I just can’t imagine what that property would be worth if the land were used for some other purpose.
Especially if the improvements are made at taxpayer expense (regardless if it is local or federal).

You are right this airport issue is not in the best interest of the city of Arcola. I served on council for 14 years and heard from the majority of citizens in the past 2 years,THEY DO NOT WANT the expansion of the Houston Southwest Airport airport. The present city gorernment is not serving in the best interest of Arcola citizens. These city officals were elected to represent the citizens of Arcola. The Mayor and Council have said WE RUN THIS CITY and WE know what is right for this CITY. This is truly wrong!! The airport owner is using our tax money from the U.S.Government to expand HIS PRIVATE AIRPORT.Looks like we are suporting GRIFFHEBERT AIRPORT.

Promoting the diversion of South Post Oak through Newpoint Estates is a bad decision by the Fort Bend County Judge, as it enables the expansion of Houston SW Airport.
We taxpayers should not have to line the pockets of Jamie Griffith, who does not even live in Fort Bend County.
If he wants a better airport, let him go build one out in the middle of the country somewhere and leave us alone.

Tom, Thanks for your continued vigilance on this issue. Although, I am not looking forward to increased flight operations resulting from an expanded airport; I am more concerned with what appears to be goverment incompetence at best and corruption at worst. The numerous contradictions made by the various governmental entities that you have so diligently chronicled reflects poorly on our local representatives. As this current crop does not fare well with the transparency that you bring to their actions let’s hope the electorate steps in and corrects the problem. Keep up the good work. Ric

The Houston Southwest Airport has received grants contrary to FAA guidelines and standards. This is highly suspicious, as many of decisions made to permit this sub-standard airport to receive money was made by one man: FAA’s own Mike Nicely.
In order to receive our tax dollars through the FAA grant, an airport must be included in the National Plan of Integrated Airport Systems (NPIAS). The NPIAS identifies those public-use airports considered to be safe, efficient, and within an integrated system of airports in order to meet the needs of civil aviation, national defense, and the Postal service. This airport does not meet the FAA’s own safety standards as stated below, and so it did not meet the definition for inclusion.
Granting of these funds is contrary to FAA Order 5100.38B, Change 1, dated January 8, 2004
para 36. Mandatory Standards.
In complying with Assurance 34, a sponsor is required to comply with all appropriate technical guidelines incorporated into identified advisory circulars, and these standards become mandatory for the project being funded. The list of the advisory circulars is published electronically on the World Wide Web. Any guidance that needs to be specifically required for a project other than that identified in the headquarters list of current advisory circulars should be added to the project as a special condition. Standards in effect on the date of allocation of AIP funds to a project apply to that project. Standards that become effective after the date of allocation may be applied to the project by mutual agreement between the FAA and the sponsor. As allowed in Title 49 U.S.C., Section 47105©, where states have established and the Secretary has approved airport development standards at nonprimary, public-use airports (other than standards for safety of approaches) the applicable State standards shall be used. Any modification to the technical standards of the advisory circulars identified must be processed in accordance with the procedures of FAA Order 5300.1, “Approval Level of Modification of Airport Design Standards”.
One of the specific violations of these “mandatory standards” is the Runway Safety Area (RSA) for Runway 9 (west side of the airport). Per AC 150/5300-13, Chg 8, Chapter 3, paragraph 305c:
Sub-standard RSAs. RSA standards cannot be modified or waived like other airport design standards. The dimensional standards remain in effect regardless of the presence of natural or man-made objects or surface conditions that might create a hazard to aircraft that leave the runway surface.
It was common knowledge that Houston Southwest did not meet RSA standards especially because of McKeever Road. To quote Mike Nicely of the FAA; “One of the impediments that prevent Houston Southwest from meeting FAA design standards is the present location of McKeever Road near the west end of the runway. Vehicles traveling on McKeever Rd violate the runway threshold-siting surface…allowing McKeever Rd. to exist in it’s present state or in an improved state….would conflict with FAA design standards. In addition, McKeever Rd. in its present location would preclude any extension of the runway.”
This airport was not within compliance of the “current standards for safety of approaches” as of February 24, 2005 when the grant was awaiting its rubber-stamp approval from puppet TxDoT. Per Linda Howard, TxDoT Aviation Division:
The FAA decides where the discretionary money goes. We showed a potential project in the NPIAS/CIP for the airport; however, the FAA makes the decision on what discretionary funds are available and which airports get how much. They are often helped in this decision-making by congressional delegations. The funds will likely flow through our agency because we are a block grant state for federal funds.
Note the term “congressional”. And then note that the owner of the airport has contributed the maximum amount to Congressman Tom DeLay’s campaign for several years.
Could Mr. Nicely have received congressional pressure to reverse his concerns about Houston Southwest’s non-compliance with FAA standards? And of course, the ugly terms “graft and corruption” can not be forgotten here.
Even the proposal of this grant violates FAA’s own guideline that “Airports should be compatible with surrounding communities…” by dismissing the opposition expressed below:
(1) FAA and TxDoT have copies of a 2003 petition with approximately 1000 signatures of Texas citizens opposing the use of tax dollars for this airport.
(2) Fort Bend County considered purchasing the airport. However, after review of the feasibility study for the purchase of the airport, the county declined to sponsor the airport.
(3) Three Fort Bend County cities (Rosenberg, Richmond, and Arcola) passed 2003 resolutions against the governmental support of the airport.
Why so much opposition?
FACTS: The airport is landlocked by five railroad tracks for the Union Pacific and BNSF on the east and south, two canals (one to the north and two to the east), two roads to the north (McKeever) and east (FM 521), and three residential areas-north, west, and east. Per the FAA, the airport is in congested airspace, and has potential conflicts with Hobby Airport, Ellington Field and Sugar Land Municipal. The airport is within a flood plain. This airport is limited to one runway which is contrary to prevailing winds. There are three other airports 30 minutes or less away from Arcola: Hobby, Brazoria and Sugar Land. The fact that Sugar Land is located only 14 miles away from Houston Southwest, and is well within the NPIAS Standards of 20 miles between airports, means that funding for Houston Southwest is a redundant use of tax dollars. There are also additional smaller airstrips and airports in the area.
Any dollars spent for the improvement of this airport would be misdirected, misappropriated and misused. An investigation is highly warranted.

Just caught an article on Hebert’s endorsement of Delay. No big surprise since they are all part of the same network. Check how they pass their contributions around from one to the other (even our local Mayor Allen Owen shares many of these contributors and endorsements).
On a side note remember how Hebert smeared his opponent out of the race from a 22 year old juvenile act and his claim that the road diversion and airport expansion are not related projects even though one can not occur without the other?

Some musings on today's Fort Bend Star aka Bev's newsletter

The Fort Bend Star and Bev Carter (it's colorful editor-in-chiefly bad journalism) spent a great deal of ink today trying to take me personally to task and discredit the efforts of Save our Schools to bring facts to light that the public has a right to know. (I find that a little odd for a supposed newspaper…but that's just Bev.)A few observations/comments:
1) In the front-page Star article entitled “Baitland fighting fire with fire”, the paper ignores the fact that the article I wrote was a news story for a local on-line newspaper, FortBendNow, for which I am a reporter. The article states facts and quotes from information obtained legally through Freedom of Information Act requests. I did not personally accuse anyone of anything. The article was updated to include extensive quotes from Dr. Baitland as soon as she made them available.
It’s interesting to note, however, that the article has provoked Superintendent Baitland to be much more forthcoming in the Star today about what is involved in the outside investigation into alleged misconduct by administration officials. That's the one the Board unanimously voted to launch (via an outside law firm and forensic accounting firm) in September.
The allegations are being made by John Griffin, a 14-year employee of the district and its current-but-on-leave Risk Manager. Griffin, after apparently blowing the whistle on some dealings related to the Risk Management audit and other issues, is now being painted by the administration and Baitland as a “disgruntled employee.” The word "scapegoat" is being bantered about by FBISD insiders. A report on the investigation into Griffin's allegations may come to light as early as Monday, November 14th and we will continue to follow that story and bring you the facts.
2) In Bev’s Burner – Carter’s opinion column – she also tries to paint me in a negative light and claims I have been a “constant thorn in the side of FBISD” simply because I, along with several others in the community, have been asking some tough questions and demanding some real answers about widespread mismanagement detailed in a dozen internal audits (something the Star, as yet, has declined to do. In fact, Bev keeps embarassing herself by saying that "internal audits mean they should stay internal." Unfortunately, she is quite misinformed as internal audits of public entities are public information).
Those audits, and other information embarrassing to the district, were only made public through open records requests I made and then made available free via the this site.
The district, and the former Board of Trustees, did not make any effort to make this information available to the public. Instead, in the past, they consistently hid the information by presenting and discussing the information behind closed doors in executive session Board of Trustee meetings. With the new board majority, however, for the first time the last audit was discussed in part in open session. (For summaries of what’s contained in the audits click here).
Holding these discussions in closed session and not properly posting them on published agendas may be a violation of the Texas Open Meetings Act. District Attorney John Healey is now formally investigating that matter. If demanding good and open government constitutes, in Bev’s words, “throwing a hissy fit” I guess I’ll have to plead guilty on that one.
3) Bev, who takes making illogical arguments into an art form, admits on the one hand that she’s read the audits and “they do make the district look bad.” She then claims that my appeal to the District to post the audit contents on its website for everyone to read would only serve to “justify why …the district is mismanaged.” She then seems to insult her (dwindling) readership by saying, “I guarantee you that your eyes will glaze over when you read some of those (audits).” Bev’s conclusion? “Let’s just try to figure out how we can build cheaper schools and increase standard test scores.”
The new Board of Trustees majority (President Lisa Rickert, Stan Magee, Ken Bryant and Laurie Caldwell) are waging a mighty battle at the moment to do just that – and are being opposed, denigrated and stalled at every turn.
Respectfully, Bev, we won’t be able to do what you suggest by sweeping problems under the rug, pretending they don’t exist or not talking about them as a community to find solutions.
Which brings me to interesting point #4….
4) I read with incredulity today (as I hope many of you did) the comments by Sugar Land Mayor David Wallace, Missouri City Mayor Allen Owen and Greater Fort Bend Economic Development Council president Herb Appel as they weighed in on the Fort Bend ISD controversy.
Are they concerned about low test scores? Are they worried about the fact that Fort Bend ISD has merely an “acceptable” rating and we now have only one “exemplary” school in the entire District? Are they demanding answers about why five schools did not meet Adequate Yearly Progress this past year? Are they looking for solutions for how we can get our student/teacher ratio out of the basement (currently FBISD ranks 1002 out of 1031 districts statewide)? Have they even read the audits to understand the issues involved or the evidence of waste and mismanagement contained in them?
Apparantly not. (At least if they are being quoted correctly by the Star.)
What are these stalwart leaders of our community concerned about? Selling houses and bringing more business to Fort Bend. Period. It seems to matter not to them (really, you have to read the article to believe it) whether or not the schools or education here really are top-notch – we just need to make sure that’s the perception everyone has.
Mayor Owen even goes as far as to say, “People read the local papers to get the feel of a community, which is why it is critical that they read about good things rather than negative ones.” (I can’t make stuff this good up.)
The clear message to the Board of Trustees and anyone else who dares to demand accountability? -- “Shut up, be quiet and don’t rock the boat. There are a lot of people making a lot of money here and that’s much more important than whether or not our kids are really getting a good education.”
Really? Is that how we as a community feel? Is that what Fort Bend is all about? If you don’t feel like “shutting up” -- make your voice heard.
Write a letter to a local editor letting them know you don’t just want them to report “good news” all the time; write a letter to a Board of Trustees member letting them know what you expect in the way of fiscal accountability and open governance; call or write Messers. Appel, Owen or Wallace to let them know what you think about their “don’t rock the boat” comments.
We can and should have a top-rated school District in Fort Bend. We have the teachers, the resources and talent collectively to achieve that. Why aren’t our community leaders demanding it?

Hopefully other grassroots movements will see through the chafe and get their people active this election season. I know we will! Why should voters be paying taxes to support "business as usual" and the EDC?

This has been the mind set of the entire area ever since they saw the big bucks that First Colony Development was going to bring.

Another key question for these three:
What role do they believe the city and county governments and the EDC have in helping FBISD properly project, plan and accommodate all this rapid growth they keep pushing (and profiting from) here?
They bring in new businesses, build more homes, attract people here with the allusion of a top school district (when in fact it's really now just barely average). When we have schools bursting at the seams and classroom sizes bigger than almost every other district in the state and a lot of other problems in our schools because of this rapid growth, then these guys have the nerve to criticize the Board for trying to deal with the problems they've created for us.

Note to Wallace, Appel and Owen -- why don't you read the audits and ask if you'd stand for that kind of incompetence in your own business or city operations? It might be good to have the facts about a situation before you start spouting off next time.

Anyone who really wants to understand just who runs things around here look at page TWO. In no other paper will you see those folks on the second page.
If you listen to Owens' words carefully you will see what is going on. He and his wife moved hear years ago because of the reputation of FBISD. Reputation? Really? What a flimsy reason to move. Reputations most often, whether good or bad, are built upon rumor and innuendo not facts! These folks will stop at nothing to keep the "reputation" of the district a positive one because they are controlled by the people on page two!!!

The thing that upset me the most in the Star was Dr. Baitland's quote about her insurance. I think back a few years ago when our premiums went up and our coverage went down. Because of that and the fact that our raise was so small, I actually lost money, and here is Dr. Baitland majking (I cannot get the j to go away) over $200,000 a year and she gets her premiums paid and her deductibles paid! If nothing else you would think a superintendent would show some compassion and sympathy for the employees and pay her on premiums. I thought she sounded like an Enron employee.

One of the many problems with leadership today in America. So few are willing to do it without major perks. The rule of lead by example has been dead for many generations.
I remember a few years back a factory owner in the North had his plant burn down just before x-mas and he kept all employees on the payroll. It made the national news. Now why should that be such a rare event as to garner that much national attention.

I remember one adminstrator(in another district) asking me why I was working so hard on a special prject with a student. They said, "You have to know that people from her background aren't going to make it very far."

I know several home sales people that don't like what the local developers/politicos are doing but are afraid to speak up. One I know actually helped get people involved in a movement in our community against some negative land use issues here. It demonstrated to me that many do care and not all sell out to the Houston special interests making a fast buck here.

I just wanted to wish a fond fare-well to a respectable editor/reporter at the Fort Bend Sun that resigned recently. I found Mr. Kumar to be a hard working and very ethical individual. Hopefully he was not run off because of his balanced reporting/leadership. Something other local news sources could learn from.

Ck this comment out on the district bond rating from FBN.com and how excessive growth has negatively impacted the ratings and hurts our ability to cheaply add more schools. This supports the case for legislative action to require developer kick-in to help reduce start-up costs on schools undergoing this demand.
